Rule 89
Extraordinary family instincts and gifts
(1) If an employee dies immediately or as a result of an accident in the course of the Legislature-Parliament or government work, his wife or husband will receive an extraordinary family allowance monthly at the rate of fifty percent of the minimum pension as per sub-section (4) of section 50 of the Act and The deceased employee will be given a lump sum for three months of severance pay as an additional gratuity.
(2) The widowed husband or widowed wife of an employee will be recognized only in the following cases:-
(a) Before the incident of death due to the above-mentioned causes, the employee must have had a marital relationship.
(b) Leave should not have been changed at the time of death of the employee.
(3) If there is no widowed wife or even if the leave has been terminated before the death of the husband, the child of the deceased employee born from such a widow or the adopted child adopted by the deceased employee may be given a lump sum additional gratuity as per sub-rule (1). If such descendants or adopted sons or adopted daughters are under the age of eighteen years, the committee will give monthly extraordinary family allowance at the rate of the amount determined by the committee so that it does not increase to two-thirds of the extraordinary family allowance received by the widowed husband or widow until they reach the age of eighteen years.
(4) If there is no widow or widower, offspring or adopted son or adopted daughter of the deceased employee, and if the employee has both or one of the dependent parents, then a lifetime family allowance equal to two-thirds of the extraordinary family allowance received by the widower or widowed wife will be provided.
(5) If there is any dispute regarding the deceased employee's widow, widower or descendants, the committee can take action in a reasonable and just manner.
(6) If there is no widow, child, adopted son, adopted daughter, mother or father of the deceased employee, and if such employee has a dependent brother or sister or any of them, the number of family status will be given to the widowed woman for such a period as the committee deems appropriate.Damasahi will be able to provide family life at a rate determined not to exceed two-thirds. Explanation: For the purpose of this rule, 'mother-in-law' also means 'mother-in-law' in case of a married female employee.
(7) If an employee dies in the course of the Legislature-Parliament or government work, the death shall be deemed to have occurred in the course of the Legislature-Parliament or government work.
